Charles Schwab has put a number on how much the CLARITY Act actually matters to bitcoin traders, and it is smaller than the headlines suggest. In its Weekly Trader’s Outlook, the brokerage said shifting odds of the crypto market-structure bill passing explained only about 4.3% of bitcoin’s daily price change this year, a finding that reframes the debate over the bill’s passing odds heading into the Senate’s summer recess.
The comment is notable because it comes from a mainstream brokerage rather than a crypto-native shop, and because it lands while the full Senate is running out of calendar to act. Schwab’s framing is cautious rather than bullish or bearish: the bank argues the legislation is important for the long-term narrative, but that its week-to-week odds are not the dominant force moving bitcoin right now. Schwab’s own factor table digs deeper. Excluding liquidation effects, the bank said CLARITY Act odds explained 8.0% of bitcoin’s daily price changes, while 60.2% of the movement remained unexplained or idiosyncratic. That decomposition, not repeated by other outlets, is the crux of Schwab’s message: liquidation flows and noise, not legislative headlines, are doing most of the work.
This is a different tone from Schwab’s earlier public stance. The brokerage has previously been vocal on the policy itself, having urged the U.S. Senate to pass the crypto CLARITY Act, and it has been leaning into digital assets after rolling out spot bitcoin trading to clients.
Why the CLARITY Act’s outlook matters for crypto regulation
The CLARITY Act is the U.S. digital-asset market-structure bill currently under Senate negotiation. Its purpose is to define which regulator oversees which tokens, the kind of clarity firms have argued for years is missing, so passage odds are effectively a proxy for how quickly the sector gets a rulebook.
Schwab’s timing warning is the practical issue. A separate Schwab market update said failure to pass the bill before the Senate’s August summer recess could delay it until after the midterm elections, pushing any regulatory clarity well into 2027.
That same update struck the more constructive note: passage would likely bring the institutional adoption narrative alive again and could drive bitcoin higher in the short term. In Schwab’s reading, a delay may not hurt much, but a green light could reopen upside, an asymmetry that matters for firms weighing exposure.
The industry support is not limited to brokerages. Payments company Block has also endorsed passage of the CLARITY Act, underscoring how corporate crypto players view a defined regulatory perimeter as a catalyst rather than a constraint.
What to watch next after Schwab’s comments
The clock is the first signal to monitor. MarketWatch reported on July 29 that the full Senate risked missing passage before its five-week break, with the window shrinking as political objections complicated the vote.
Price history shows how sentiment can swing on legislative signals. The same reporting noted bitcoin traded above $80,000 in the first half of May after the Senate Banking Committee advanced the bill, before sliding back toward $64,000 by late July as momentum stalled.
At press time bitcoin was trading near $64,697, roughly in line with that late-July level, while the crypto Fear and Greed Index sat at 28, in “Fear” territory.
The next hard signals are legislative: whether the Senate takes up the updated CLARITY text before it breaks, and whether the newly added ethics language survives negotiation. Future Schwab research updates, or shifting language from Senate negotiators, are the inputs that could move the passage odds Schwab is tracking, without settling the outcome either way.
